Can you renovate a property that's currently rented out?

Do I need a licence to rent my property as a holiday let on the Costa del Sol?

Yes — the regional Andalusian tourist-use licence (VUT) is mandatory. As of May 2026, Spain's national Single Registry and its number (NRUA) are no longer required after the Supreme Court annulled them (Ruling 620/2026). Town councils can also limit or suspend new licences in saturated areas (Decree 31/2024 and Decree-law 1/2025): the city of Málaga has had a moratorium in force since August 2025. Can my community of owners stop me from letting to tourists?

Since April 2025, a community of owners can restrict or ban tourist rentals with a 3/5 majority of owners representing 3/5 of the quotas; unanimity was previously required. What technical requirements must the property meet for holiday letting?

Andalusian rules (Decree 28/2016, amended by 31/2024) require, among others, air conditioning in bedrooms and living rooms if you rent in summer (May–August) and heating if you rent in winter (December–March), adequate ventilation with a blackout system, a first-aid kit and local tourist information.
